1. Agreement
These Terms of Service ("Terms") govern your use of the Talkwave app for iOS and Android and related services provided by Talkwave Inc ("Talkwave," "we," "us," or "our"). By creating an account, accepting these Terms, or using Talkwave, you agree to these Terms and the Community Guidelines. The Privacy Policy explains how we handle personal information. If you do not agree, do not use the service.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into these Terms. Provide accurate information, keep your sign-in method secure, and do not let another person use or take over your account. You are responsible for activity through your account until you tell us about unauthorized access. Talkwave may decline to create a new account with an email address whose domain is not accepted for new accounts, or whose domain has already been used for too many new accounts that day.
3. The service
Talkwave is a voice chat and friendship platform. Users can join small voice rooms organized by topic, receive a room alias and a cartoon avatar for each room session, keep track of people they have met and write private notes about them, send friend requests, add a profile photo that only their friends can see, exchange private text messages with accepted friends, follow friends into rooms, use a daily Hook allowance to join the room of someone they have met when room and privacy rules allow, and use safety tools. Features and availability may change, and some functions require compatible devices, permissions, network access, or third-party services.
Version 1.0 is free. It contains no in-app purchases, subscriptions, advertising, or paid digital content, and Hook allowances cannot be bought.
4. Your content and license
You are responsible for the voice, text, profile information, profile photos, private notes, report notes, and other content you submit or communicate ("User Content"). Only share content that you have the right to share.
You grant Talkwave a non-exclusive, worldwide, royalty-free license to host, transmit, reproduce, format, and otherwise process User Content only as reasonably needed to operate, secure, and support the service, enforce these Terms and the Community Guidelines, and comply with law. This license ends when the content is deleted from our systems under the Privacy Policy, except for content kept under a documented legal hold and copies that other users have already received.
A profile photo is shown only to you and your friends, never in rooms, and must follow the Community Guidelines. Friends who can see your photo can report it, and Talkwave may remove a photo that breaks these Terms or the Community Guidelines. Private notes are visible only to you.
Live room voice is transmitted for the conversation and is recorded by Talkwave as described in Section 6 and the Privacy Policy. Other participants may also record outside Talkwave using their own device. Do not say anything in a room that you are not comfortable sharing with the people in it.
5. Conduct
You must follow the Community Guidelines. You may not use Talkwave to:
- threaten, bully, harass, exploit, stalk, or endanger another person;
- share sexual exploitation material, sexual content involving minors, or content that facilitates abuse;
- promote or coordinate violence, hate, self-harm, illegal acts, fraud, or dangerous activity;
- impersonate another person or misrepresent an affiliation;
- expose private or confidential information without authorization;
- infringe intellectual-property or other rights;
- send spam, malware, scams, or unauthorized commercial solicitations;
- use encounters, follows, Hooks, or presence information to pursue or monitor someone who does not want contact;
- evade blocks, room removals, topic restrictions, bans, age restrictions, text filters, rate limits, or other safety controls;
- disrupt the service, probe its security, access another account, or collect information through unauthorized automation; or
- submit false or bad-faith reports.
6. Safety, reports, and enforcement
Talkwave provides local mute, report, block, and room-removal tools, and automatically rejects nicknames, profile introductions, and messages that contain prohibited words. A local mute changes only what you hear; the person you mute can see that you muted them, and other members cannot. Blocking ends the friendship and stops further search, friend request, follow, and message interaction between the two accounts. You can report a room member from their member card, and a friend outside rooms from their profile or the menu in your chat with them. When enough different members of a room report the same person, that person is removed from the room and cannot re-enter rooms of the same topic for a short time; reports made outside rooms do not count toward this.
Room voice recording. To counter crime of every kind, Talkwave has no choice but to record room voice. We tell you this clearly every time you sign in; you must agree before using the service, and if you decline you are signed out. Recordings are used to review reports, investigate and prevent crime, and cooperate with law enforcement, and are kept as described in the Privacy Policy. If anyone uses Talkwave to commit a crime, we will give the police every assistance needed, and we may report risks to the authorities on our own initiative.
Upload limits and automatic restrictions. Each account may make up to 10 profile photo upload attempts a day, and each network up to 20. A network means one IPv4 address, or one IPv6 /64 block, and a day runs from midnight to midnight UTC. Every attempt counts, including attempts that fail or are rejected, and the app tells you before you choose a photo when few attempts remain. If an account goes over its limit, Talkwave automatically restricts that account and the network used for the attempt. If only a network goes over its limit, for example because several people share it, only that network is restricted. A restriction lasts 24 hours the first time, 30 days the second time, and 365 days the third time and every time after that. Accounts and networks are counted separately, and earlier restrictions always count, because Talkwave keeps restriction records permanently (see the Privacy Policy); a restriction that Talkwave lifts as a mistake does not count. While an account is restricted, it cannot sign in or use the service, and its email address and Apple or Google account cannot be used to sign in to or create another account. While a network is restricted, the service cannot be used from that network. A restricted account can still sign out and delete itself. Talkwave may lift a restriction early; if you believe a restriction is a mistake, email [email protected].
Talkwave reviews reports and may take action including warnings, content restriction, room removal, temporary restrictions, suspension, or account termination. We do not promise a specific review or response time. We may preserve and disclose information when reasonably needed for safety, legal compliance, or an investigation. Safety tools reduce risk but cannot prevent every harmful interaction.
7. Friends, presence, and room aliases
A room alias and a cartoon avatar are assigned at random for each room session, the alias from Talkwave's preset name lists, and both may appear in encounter history. An alias is only a label for the conversation; it does not suggest any connection with, or endorsement by, any person or rights holder associated with that name. An alias does not create a separate account or exempt anyone from these Terms. Online status and current-room information are shown only as allowed by your settings and the relationship rules described in the Privacy Policy.
8. Account deletion and termination
You may stop using Talkwave at any time. You can delete your account in the app under Me > Delete account by confirming your identity again with the account's sign-in method and then confirming deletion. The account stops working immediately and cannot be recovered; its data is deleted or de-identified within 30 days as described in the Privacy Policy.
We may restrict, suspend, or terminate access when reasonably necessary to protect users, comply with law, investigate misuse, or enforce these Terms. Automatic restrictions for going over upload limits work as described in Section 6, and a restricted account can still be deleted. You may contact [email protected] about an enforcement decision.
9. Third-party services
Talkwave relies on services provided by Apple, Google, Amazon Web Services, Cloudflare, Shorebird, and other vendors for sign-in, notifications, hosting, network delivery, profile photo storage, and app updates. Their services may be subject to separate terms and privacy practices. Talkwave is not responsible for a third party's independent conduct, but we remain responsible for our own obligations under applicable law.
10. Intellectual property
Talkwave and its software, design, branding, and service content are owned by Talkwave Inc or its licensors. These Terms give you a limited, personal, non-transferable, revocable right to use the service for its intended purpose and do not transfer ownership of any Talkwave intellectual property. To report claimed infringement, email [email protected] with enough information for us to evaluate the claim.
11. Disclaimers and limitation of liability
Talkwave is provided on an "as available" basis. To the extent permitted by law, we do not promise uninterrupted or error-free access, that every user will behave appropriately, or that every report will prevent future harm.
To the extent permitted by law, Talkwave Inc is not liable for indirect, incidental, special, consequential, or punitive damages arising from the service. Nothing in these Terms excludes or limits any warranty, remedy, or liability that cannot lawfully be excluded or limited.
12. Governing law and disputes
These Terms are governed by applicable law. Nothing in these Terms takes away any protection that the consumer laws of the place where you live give you and that cannot be waived by agreement. These Terms do not require arbitration, do not waive your right to take part in a class action, and do not set a monetary cap on liability.
13. Changes
We may update these Terms when the service or legal requirements change. Each version is identified by its effective date. When a change materially affects your rights, we will provide notice through the app or another appropriate means and request renewed acceptance where the law requires.
